Terms and Conditions of Sale — Tomkat, Wine Bar with Kitchen
The website tomkat.it is operated by Bianco Consiglio S.r.l. and Sottocolle S.r.l.s., with registered office at Via Puccini 1940/V – 55016 Porcari (LU), Italy — VAT no. 02697230460 — which run the wine bar with kitchen "Tomkat" at Via Calderia 12, 55100 Lucca.
1. Subject matter. Through the website you can purchase wine tastings to be held at our venue at Via Calderia 12, Lucca, and gift cards redeemable for tastings. No physical products are sold or shipped.
2. Booking and payment. A tasting is booked by choosing the option, date and number of people, with payment in advance online. The price shown is per person. Payment is followed by a confirmation email, which serves as proof of booking. Tastings start at 6:00 PM, unless otherwise agreed in writing.
3. Minimum number of participants. Themed tastings require a minimum of 4 people. The "Tomkat’s Choice" tasting can also be booked by one person.
4. Changes and cancellations. The date can be changed free of charge up to 48 hours before the booked time, by writing to or calling +39 376 203 5395. Cancellations notified within the same deadline entitle the customer to a full refund or, at the customer’s choice, a voucher of the same value. Cancellations after the deadline and no-shows are not eligible for a refund.
5. Right of withdrawal. Pursuant to Article 59, letter n) of the Italian Consumer Code (Legislative Decree 206/2005), the 14-day right of withdrawal does not apply to leisure services provided on a specific date, such as tastings booked for a set date. The cancellation terms in point 4, which are more favorable to the customer, remain unaffected.
6. Gift cards. Gift cards are delivered by email, can be redeemed on the website for any tasting, cannot be exchanged for cash and do not expire. If the price of the tasting exceeds the value of the card, the difference is paid at checkout; any remaining balance can still be used.
7. Alcohol consumption. Tastings involve the consumption of alcoholic beverages and are restricted to people aged 18 and over. We drink and serve responsibly.
8. Allergies and intolerances. Please let us know when booking (notes field) or by email. Although we indicate allergens, we cannot guarantee the complete absence of cross-contamination.
9. Variations. The wines in the tasting may vary depending on availability, while keeping the level and value of the chosen option. If we cancel (force majeure, minimum number not reached), the customer can choose between a new date and a full refund.
10. Governing law and jurisdiction. Italian law applies. For consumers, the competent court is that of the consumer’s place of residence or domicile.
